For those of you unable to make your monthly mortgage payment there are several important points you need to be aware of before you decide on a course of action. If you decide to walk away from the house and let the lender file a foreclosure, you can save yourself a lot of aggravation by giving what is called a deed in lieu of foreclosure. In essence, you are signing over the title of the house to the lender instead of making them go through the court system. Although it still negatively affects your credit, it shows that at least you were cooperative and were trying to solve the problem.

If you sell the property, you might want to apply for a short sale. In a short sale, the sales price is lower than the amount owed. The lender will want to examine the numbers and see if it is a good option for them. Whatever the net proceeds are after all expenses are paid, go to the lender. The seller doesn't receive any money. The problem with this is that many lenders are requiring that the owners sign a note for the difference between what is owed and what they received. This liability can then be transferred to any of your other assets or future purchases.

Homeowners can look to the Federal Housing Administration for assistance in dealing with their lenders. They will try to find a creative solution for you and in some cases they have been able to stop foreclosures if the loan needs to be reviewed under predatory lending laws.

Another possibility is to work out a forbearance agreement with the lender, if your financial crisis is temporary. These sorts of agreements usually allow you to repay the amounts due over a short term (about 12 months) period. You must be able to prove that your financial crisis is only temporary to have any chance of getting this agreement.

Of course, you can also seek a loan modification, but with the overwhelming number of modification cases, it can often be a difficult and stressful process. Be prepared to deal with a number of lender employees and be ready to repeat your story over and over to get the process underway.
